方：_簽訂日期：_年_月_日租賃合同書出租方(甲方)lessor(hereinafterreferredtoaspartya)：_承租方(乙方)lessee(hereinafterreferredtoaspartyb)：_根據(jù)國(guó)家有關(guān)法律、法規(guī)和有關(guān)規(guī)定，甲、乙雙方在平等自愿的基礎(chǔ)上，經(jīng)友好協(xié)商一致，就甲方將其合法擁有的物業(yè)出租給乙方使用，乙方承租使用甲方廠房事宜，訂立本合同。inaccordanceithrelevantchineselas、decreesandpertinentrulesandregulations,partyaandpartybhavereachedanagreementthroughfriendlyconsultationtoconcludethefolloingcontract.一、物業(yè)地址locationofthepremises甲方將其所有的位于合肥經(jīng)濟(jì)技術(shù)開發(fā)區(qū)_的廠房及其附屬設(shè)施在良好狀態(tài)下出租給乙方_使用。具體見附件廠房平面圖。partyaillleasetopartybthepremisesandattachedfacilitiesallonedbypartyaitself,hichislocatedat_andingoodconditionfor_.concretedetailsinplanimetricmapincontractschedule.二、物業(yè)狀況出租廠房的登記面積為_平方米(建筑面積)。房屋結(jié)構(gòu)為鋼結(jié)構(gòu)。theregisteredsizeoftheleasedpremisesis_squaremeters(grosssize).thestructureofpremisesisstealstructure三、租賃期限leaseterm租賃期限自_年_月_日起至_年_月_日止，為期_年，甲方應(yīng)于_年_月_日將廠房騰空并交付乙方使用。theleasetermillbefrom_(month)_(day)_(year)to_(month)_(day)_(year).partyaillclearthepremisesandprovideittopartybforusebefore_(month)_(day)_(year).四、租金rental1.數(shù)額：_雙方商定租金為每月人民幣_(tái)元整,乙方以_形式支付給甲方。amount:therentalillbe_permonth.partybillpaytherentaltopartyaintheformof_in_.2.租金按_個(gè)月為一個(gè)支付周期第一期租金于_年_月_日以前付清以后每期租金于每一支付周期_日以前繳納，先付后住(若乙方以匯款形式支付租金，則以匯出日為支付日，匯費(fèi)由匯出方承擔(dān))。甲方收到租金后予書面簽收。paymentofrentalillbeoneinstallmenteverymonth(s).thefirstinstallmentillbepaidbefore_(month)_(day)_(year).eachsuccessiveinstallmentillbepaid_eachmonth.partybillpaytherentalbeforeusingthepremisesandattachedfacilities(incasepartybpaystherentalintheformofremittance,thedateofremittingillbethedayofpaymentandtheremittancefeeillbebornebytheremitter.)partyaillissuearittenreceiptafterreceivingthepayment3.如乙方逾期支付租金超過(guò)十天，則每天以月租金的0.5%支付滯納金如乙方逾期支付租金超過(guò)十五天，則視為乙方自動(dòng)退租，構(gòu)成違約，甲方有權(quán)收回廠房，并追究乙方違約責(zé)任。incasetherentalismorethantenorkingdaysoverdue,partybillpay0.5percentofmonthlyrentalasoverduefineeveryday,iftherentalbepaid2019daysoverdue,partybillbedeemedtohaveithdranfromthepremisesandbreachthecontract.inthissituation,partyahastherighttotakebackthepremisesandtakeactionsagainstpartyb'sbreach.五、保證金deposit1.為確保廠房及其附屬設(shè)施之安全與完好，及租賃期內(nèi)相關(guān)費(fèi)用之如期結(jié)算，乙方同意于_年_月_日前支付給甲方保證金人民幣_(tái)元整，甲方在收到保證金后予以書面簽收。guarantyingthesafetyandgoodconditionsofthepremisesandattachedfacilitiesandaccountofrelevantfeesaresettledonscheduleduringtheleaseterm,partybillpay_topartyaasadepositbefore_(month)_(day)_(year).partyaillissuearittenreceiptafterreceivingthedeposit.2.除合同另有約定外，甲方應(yīng)于租賃關(guān)系消除且乙方遷空、點(diǎn)清并付清所有應(yīng)付費(fèi)用后的當(dāng)天將保證金全額無(wú)息退還乙方。unlessotheriseprovidedforbythiscontract,partyaillreturnfullamountofthedepositithoutinterestonthedayhenthiscontractexpiresandpartybclearsthepremisesandhaspaidallduerentalandotherexpenses.3.因乙方違反本合同的規(guī)定而產(chǎn)生的違約金、損壞賠償金和其它相關(guān)費(fèi)用，甲方可在保證金中抵扣，不足部分乙方必須在接到甲方付款通知后十日內(nèi)補(bǔ)足。incasepartybbreachesthiscontract,partyahasrighttodeductthedefaultfine,compensationfordamageoranyotherexpensesfromthedeposit.incasethedepositisnotsufficienttocoversuchitems,partybshouldpaytheinsufficiencyithintendaysafterreceivingtherittennoticeofpaymentfrompartya.六、甲方義務(wù)obligationsofpartya1.甲方須按時(shí)將廠房及附屬設(shè)施(詳見附件)交付乙方使用。partyaillprovidethepremisesandattachedfacilities(seetheappendixoffurniturelistfordetail)onscheduletopartybforusing.2.廠房設(shè)施如因質(zhì)量原因、自然損耗或?yàn)?zāi)害而受到損壞，甲方有修繕并承擔(dān)相關(guān)費(fèi)用的責(zé)任。incasethepremiseandattachedfacilitiesaredamagedbyqualityproblems,naturaldamagesordisasters,partyaillberesponsibletorepairandpaytherelevantexpenses.3.甲方應(yīng)確保出租的廠房享有出租的權(quán)利，反之如乙方權(quán)益因此遭受損害，甲方應(yīng)負(fù)賠償責(zé)任。partyaillguaranteetheleaserightofthepremises.otherise,partyaillberesponsibletocompensatepartyb'slosses.4.七、乙方義務(wù)obligationsofpartyb1.乙方應(yīng)按合同的規(guī)定按時(shí)支付租金及保證金。partybillpaytherental,thedepositandotherexpensesontime.2.乙方經(jīng)甲方同意，可在廠房?jī)?nèi)添置設(shè)備。租賃期滿后，乙方將添置的設(shè)備搬走，并保證不影響廠房的完好及正常使用。partybmaydecoratethepremisesandaddnefacilitiesithpartya'sapproval.henthiscontractexpires,partybmaytakeaaytheaddedfacilitieshichareremovableithoutchangingthegoodconditionsofthepremisesfornormaluse.3.未經(jīng)甲方同意，乙方不得將承租的廠房轉(zhuǎn)租，并愛(ài)護(hù)使用該廠房，如因乙方過(guò)失或過(guò)錯(cuò)致使廠房及設(shè)施受損，乙方應(yīng)承擔(dān)賠償責(zé)任。partybillnottransfertheleaseofthepremisesithoutpartya'sapprovalandshouldtakegoodcareofthepremises.otherise,partybillberesponsibletocompensateanydamagesofthepremisesandattachedfacilitiescausedbyitsfaultandnegligence.4.乙方應(yīng)按本合同規(guī)定合法使用該廠房，不得擅自改變使用性質(zhì)。乙方不得在該廠房?jī)?nèi)存放危險(xiǎn)物品。否則，如該廠房及附屬設(shè)施因此受損，乙方應(yīng)承擔(dān)全部責(zé)任。partybillusethepremiseslafullyaccordingtothiscontractithoutchangingthenatureofthepremisesandstoringhazardousmaterialsinit.otherise,partybillberesponsibleforthedamagescausedbyit5.乙方應(yīng)承擔(dān)租賃期內(nèi)的水、電、煤氣、電訊等一切因?qū)嶋H使用而產(chǎn)生的費(fèi)用，并按單如期繳納。partybillbearthecostofutilitiessuchascommunications,ater,electricity,gas,managementfeeetc.ontimeduringtheleaseterm.6.乙方自行委托物業(yè)管理公司對(duì)承租的物業(yè)進(jìn)行管理并簽訂物業(yè)管理協(xié)議，物業(yè)管理費(fèi)自行承擔(dān)。partybillsignetheagreementofpremisesmanagementiththemanagementcompanyhichasemployedbypartybitself,andbearthemanagementitself.7.乙方若需要對(duì)租賃物業(yè)進(jìn)行裝飾裝修、制作外墻廣告等，必須經(jīng)過(guò)甲方的同意。ithouttheapprovalofpartya,partybcantdecoratethepremises,makeadvertisementetc.ontheoutall.八、合同終止及解除的規(guī)定terminationanddissolutionofthecontract1.乙方在租賃期滿前如需退租或續(xù)租，應(yīng)提前兩個(gè)月通知甲方，由雙方另行協(xié)商退租或續(xù)租事宜。在同等條件下乙方享有優(yōu)先續(xù)租權(quán)。ithintomonthsbeforethecontractexpires,partybillnotifypartyaifitintendstoextendtheleasehold.inthissituation,topartiesilldiscussmattersovertheextension.2.租賃期滿后，乙方應(yīng)在當(dāng)天將廠房交還甲方任何滯留物，如未取得甲方諒解，均視為放棄，任憑甲方處置，乙方?jīng)Q無(wú)異議。hentheleasetermexpires,partybillreturnthepremisesandattachedfacilitiestopartyaithindays.anybelongingsleftinitithoutpartya'spreviousunderstandingillbedeemedtobeabandonedbypartyb.inthissituation,partyahastherighttodisposeofitandpartyaillraisenoobjection.3.本合同一經(jīng)雙方簽字后立即生效未經(jīng)雙方同意，不得任意終止，如有未盡事宜，甲、乙雙方可另行協(xié)商。thiscontractillbeeffectiveafterbeingsignedbybothparties.anypartyhasnorighttoterminatethiscontractithoutanotherparty'sagreement.anythingnotcoveredinthiscontractillbediscussedseparatelybybothparties九、違約及處理breachofthecontract1.甲、乙雙方任何一方在未征得對(duì)方同意的情況下，不履行本合同規(guī)定條款，導(dǎo)致本合同中途中止，則視為該方違約，雙方同意違約金為人民幣_(tái)元整，若違約金不足彌補(bǔ)無(wú)過(guò)錯(cuò)方之損失，則違約方還需就不足部分支付賠償金。duringtheleaseterm,anypartyhofailstofulfillanyarticleofthiscontractithouttheotherparty'sapprovalillbedeemedtobreachthecontract.bothpartiesagreethatthedefaultfineillbe_.incasethedefaultfineisnotsufficienttocoverthelosssufferedbythefaultlessparty,thepartyinbreachshouldpayadditionalcompensationtotheotherparty.2.乙方未按合同約定的用途使用租賃物或擅自轉(zhuǎn)租的，甲方可解除合同，并有權(quán)扣除保證金作為乙方違約金。十、爭(zhēng)議解決disputeresolve若雙方在執(zhí)行本合同或與本合同有關(guān)的事情時(shí)發(fā)生爭(zhēng)議，應(yīng)首先友好協(xié)商協(xié)商不成，可向合同履行地人民法院提起訴訟。本合同一經(jīng)雙方簽字后立即生效未經(jīng)雙方同意，不得任意終止，如有未盡事宜，甲、乙雙方可另行協(xié)商。bothpartiesillsolvethedisputesarisingfromexecutionofthecontractorinconnectioniththecontractthroughfriendlyconsultation.incasetheagreementcannotbereached,anypartymaysummitthedisputetothecourtthathasthejurisdictionoverthematter.十一、免責(zé)條件exceptionclause1、因不可抗力原因致使本合同不能繼續(xù)履行或造成的損失，甲、乙雙方互不承擔(dān)責(zé)任。intheeventofthereasoncausedbyforcemajeuremakethecontractnotperformorprobuctanyloss,partyaorpartybillnotbeartheobligationseachother.2、因國(guó)家政策需要拆除或改造已租賃的房屋，給甲、乙雙方造成損失的，互不承擔(dān)責(zé)任。ifthelossofbothpartiescausedbyremoveorrecontructivethepremiesduetonationalpolicies,partyaorpartybillnotbeartheobligationseachother.3、因上述原因而終止合同的，租金按照實(shí)際使用時(shí)間計(jì)算，不足整月的按實(shí)際天數(shù)計(jì)算。intheeventofthereasonmentionedabove,paymentofrentalillbecountedattheactualmonthsoractualdaysifitdontreachafullmonth.十二、其他others1.本合同附件是本合同的有效組成部分，與本合同具有同等法律效力。anyannexistheintegralpartofthiscontract.theannexandthiscontractareequallyvalid.2.本合同壹式貳份，甲、乙雙方各執(zhí)一份。thereare2originalsofthiscontract.eachpartyillhold1original(s).3.本合同中英文內(nèi)容相同，若有不同之處，以中文為準(zhǔn)。thechineselanguageversionandtheenglishlanguageversionofthisagreementshallhaveequallegaleffect.intheeventofconflict,thechineselanguageversionofthisagreementshallprevail.4.甲、乙雙方如有特殊約定，可在本款另行約定：_otherspecialtermsillbelistedbellos:_甲方：_partya證件號(hào)碼：_idno聯(lián)絡(luò)地址：_address電話：_tel:代理人：_representative:日期：_date:
