Party A must deliver the property and the furnitures detailed in Appendix II on time, if fails, Party B has the right to terminate this Agreement, and Party A shall return the deposit and prepaid rent to Party B and shall pay Party B the compensation of amount hich equals to to months rent. 2.3 租期屆滿,甲方有權(quán)收回出租房屋及附件二所列全部設(shè)備,乙方亦應(yīng)如期交還;乙方如要求續(xù)租,則享有優(yōu)先續(xù)租權(quán),但必須在本租約期滿前 2個月向甲方提出書面申請,租金雙方另行協(xié)商。租賃終止或解除時,如甲方不及時接收房屋,乙方有權(quán)將房屋鑰匙按通訊地址寄給甲方,以此視為乙方交還完畢以及甲方驗收合格。 On expiry of this lease term, Party A has the right to take back the leased property(including all the furnitures detailed in Appendix II)in full, and Party B shall take back the leased property on time. If Party B ishes to rene the Leased Premise, Party B shall have the priority to rene the lease ith a ritten notice 2 months in advance to Party A. In case Party B fails to pay the rent after receiving the invoice as agreed in the Tenancy, penalty of 3‰ for each overdue payment should be charged. 3.4 租金以人民幣支付。在本租約有效期內(nèi),租金不予調(diào)整。 The rent shall be paid in RMB. Before making such deductions, Party A shall inform Party B ith ritten notice of the amount hich it intends to deduct and the reason for making such deductions. Party B shall be entitled to object to such deductions if Party B believes that such deductions are unreasonable or unjustified. If the security deposit is not sufficient, Party B must pay the deficiency ithin 2019 orking days of the receipt of a demand from Party A. 4.4 押金以人民幣支付,甲方收到押金時應(yīng)向乙方開具收據(jù)。 The deposit shall be paid in RMB. Party A shall issue an official receipt to Party B upon the receipt of deposit. 第5條 其它費用:_______________ Other Charges:_______________ 5.1 乙方在租賃期內(nèi)所用的水、電、煤氣(天然氣),物業(yè)管理公司或公共事業(yè)部門將每月按房屋實際耗用量結(jié)算,由乙方按單繳付。 During the period of Lease term, Party B shall pay monthly charges for usage of ater, electricity, gas based on the actual consumption amount billed by the management office or relating government utility bureaus. 5.2 乙方所用電話, 按電信部門相關(guān)標準收費,每月根據(jù)實際用量結(jié)算,由乙方按單繳付。 Telephone bills shall be paid by Party B and based on the actual usage according to the relevant standard of the the telecommunication bureau. 第6條 甲方的權(quán)利和義務(wù):_______________ Landlords Rights and Obligations:_______________ 6.1 本租約簽訂后,甲方不得無故收回房屋,如甲方中途要求收回房屋或擅自解除合同,乙方有權(quán)拒絕。在征得乙方書面同意解除租約后,甲方應(yīng)返還乙方已付押金及剩余租金,并向乙方支付相當(dāng)于兩個月租金的違約金。 Party A is not permitted to take back the leased property or terminate this Agreement during the term of Agreement ithout any reason. If Party A ishes to do so, Party B has the right to refuse. Upon the ritten consent of Party B to terminate the Lease Agreement, Party A shall return the deposit and prepaid rent to Party B and shall pay Party B the compensation of amount hich equals to to months rent. 6.2 甲方應(yīng)確保房屋的各項附屬設(shè)施以及家具家電均處于完好、可租賃狀態(tài)。如上述各項出現(xiàn)損壞或不能正常工作,甲方在收到乙方發(fā)出的通知后24小時內(nèi)迅速修理或修繕該損壞處。若3個日歷日內(nèi)甲方仍不能修繕或修繕無效,乙方有權(quán)停止并免于支付租金直到上述情況改進至乙方合理滿意為止,直至上述影響居住的情況改進至乙方合理滿意為止。情況嚴重影響乙方正常居住的,乙方有權(quán)以書面形式通知甲方解除本租賃合同,租金付至合同解除日,甲方應(yīng)返還乙方已付押金及剩余租金,并向乙方支付相當(dāng)于兩個月租金的違約金。 Party A ill maintain and keep all the equipments and fixtures in good leasing condition.If any of them as damaged or cannot ork in good manner, Party A should repair or remedy any defects ithin 24 hours after being notified of such defect by Party B, If Party A fails to improve the bad situation ithin three(3)calender days, Party B shall be entitled to ithhold and exempt from Rent until rectification of the situation to be the reasonable satisfaction of Party B. If the events affected the normal living of the occupant of the Premises designated by Party B badly, Party B shall issue a ritten notice to Party A to terminate this Lease Agreement, Party A shall return the deposit and prepaid rent to Party B and shall pay Party B the compensation hich equals to to monthss rent. 6.3 甲方謹在此聲明及保證甲方為出租房屋的合法擁有人并有合法地位出租此房屋于乙方。就本合同及出租此出租房屋予乙方之事,甲方已取得所有有關(guān)機構(gòu)的批準,包括政府批準及/或抵押權(quán)人的同意(如適用)甲方于本合同所做出的聲明及保證,如有錯誤或違反者,甲方須就乙方因此而引致的任何損失、損害、支出及費用做出全部補償。 Party A hereby represents and arrants that Party A is the legal oner of the leasing Premises and has the necessary legal capacity to lease the property to Party B. Party A has also obtained all the necessary authorizations from all relevant authorities in the Peoples Republic of China in respect of this Lease Agreement and the leasing of the leasing Premises to Party B, including any necessary government approvals or registrations and/or mortgagee consent (if applicable) Party A shall continue to be liable to keep Party B fully indemnified against any costs, expenses, losses and damages suffered by Party B due to any breach of Party A to its above-mentioned guarantee. 6.4 如在租賃期內(nèi),出租房屋發(fā)生所有權(quán)全部或部分的轉(zhuǎn)移、或其他影響乙方權(quán)益的事情時(甲方出售 房屋或者抵押房屋),甲方應(yīng)保證所有權(quán)人或其他影響乙方權(quán)益的第三者,能繼續(xù)遵守本合同所有條款??v使出租房屋已被轉(zhuǎn)移,如乙方于本合同下的權(quán)益受此等所有權(quán)人或第三所影響或損害,甲方須負責(zé)補償乙方的所有損失。 If during the lease term, all or part of the leasing Premises is transferred or mortgaged to a third party by Party A, or Party Bs right to use the leased property is otherise affected, Party A shall ensure that such transferee or third party having an effect on Party Bs right to use the leasing Premises ill continue to abide by the terms of this Lease Agreement. Even if the leased Premises is transferred here a transferee or a third party affects Party Bs interests under this Lease Agreement, Party A shall continue to be liable to keep Party B fully indemnified against all damages suffered by Party B. 6.5 甲方應(yīng)提供無毒無害的居住環(huán)境。如果該房屋中存在有害氣體、噪音或者其他危害健康的情形, 經(jīng)執(zhí)證機關(guān)通過專業(yè)檢測后證明房屋內(nèi)的有害氣體、噪音或者其他情形確實超過國家規(guī)定的健康標準的,乙方有權(quán)憑檢測報告解除本協(xié)議,甲方應(yīng)返還乙方全額押金和剩余租金。 Party A shall provide harmless circumstance. If there is poisonous gas, and other cases hich are hazardous to health in the apartment, hich exceed the standard regulated by government, Party B has the right to terminate this Agreement immediately. Party A shall refund the hole amount of deposit and the prepaid rent to Party B. 6.6 除本合同另有約定外,若甲方違反此租約的任何條款并在乙方發(fā)出書面通知2019天后仍未改正,乙 方有權(quán)解除此租約,收回押金,且有權(quán)要求甲方支付相當(dāng)于兩個月租金的違約金,同時租金付至 合同解除日。 Unless other agreed in this Agreement, Party B shall have the right to terminate the Lease Agreement hen Party A breaches the Lease Agreement and fails to remedy the breach after fifteen(2019) days of giving ritten notification of Party B. Party B shall be entitled to ithdra the deposit and request Party A to undertake the compensation hich equals to to monthss rent. The rental should be paid till the termination of Agreement. 第7條 乙方權(quán)利和義務(wù):_______________ Tenants Rights and Obligations:_______________ 7.1 乙方應(yīng)按期交納押金、租金及其他費用。若超過限定期限30個工作日,乙方無正當(dāng)理由仍未支付的,則甲方有權(quán)解除本租約,并要求乙方承擔(dān)相當(dāng)于兩個月租金的違約金。 Party B should pay the deposit, rent and other charges according to the Agreement term. If Party B fails to pay the above mentioned fee for over 30 orking days ithout justful reason, Party A has the right to terminate this agreement, Party B shall pay Party A the compensation of amount hich equals to to months rent. 7.2 租賃期內(nèi)未經(jīng)甲方同意,乙方不能轉(zhuǎn)租其所租房屋,私自轉(zhuǎn)租無效。 During the lease term, unless ith the agreement of Party A, Party B cannot sub-let or let in part or in full the leasing Premises. 7.3 乙方應(yīng)愛護房屋及其設(shè)備,如因使用不當(dāng)而導(dǎo)致?lián)p壞,乙方應(yīng)負責(zé)賠償。 Party B must take good care of the property; otherise Party B should pay compensation to Party A for his improper use of the property. 7.4 除房內(nèi)已有的裝飾和設(shè)施外,乙方如要增加設(shè)備或其他裝修須征得甲方同意。租賃期滿,乙方向甲方交還房產(chǎn)時,除雙方另有約定外,應(yīng)恢復(fù)其原狀(正常磨損除外)未經(jīng)甲方書面同意,乙方不得擅自設(shè)立、安裝或移動設(shè)施及設(shè)備,不能擅自設(shè)立隔斷,不得擅自對房屋的結(jié)構(gòu)改動或增加。 In addition to the decoration and equipment already in the property, if Party B ishes to make any alterations or decoration to such property, Party B should get the consent of Party A. On completion of the Lease term, Party B must hand over the property to Party A in its original condition(except for normal ear) Party B shall not erect, install or remove any fixtures or partitioning, or to make any structural additions and alterations ithout the prior ritten consent of Party A. 7.5 由于乙方或乙方關(guān)聯(lián)人員的粗心、疏忽或故意而造成房屋的損害或損失的,乙方應(yīng)當(dāng)承擔(dān)賠償責(zé)任,并允許甲方或其授權(quán)人在事先通知后進入房屋,對房屋的損失或損害進行彌補及修復(fù),由此所發(fā)生的費用由乙方負擔(dān)。 Party B shall indemnify Party A from any loss or damages to the leased property from negligent act or omission of Party B or its connecter and shall permit Party A or his authorized representatives ith advance notice to enter the leased property to repair any such loss or damage at the expense of Party B. 7.6 租賃期間,乙方必須嚴格遵守中華人民共和國的有關(guān)法律、細則、規(guī)章及法令的規(guī)定, 不得利用房屋進行違犯法律及不道德的行為。 Strictly to comply and adhere in the usage of the leased property according to all las, regulations and decrees of the Peoples Republic of China, and specifically not to permit the leased property to be used for any purpose that is unlaful or immoral. 第8條 違約責(zé)任 Breach of Agreement 任何一方違反本協(xié)議的規(guī)定,或其他在本協(xié)議內(nèi)所作的陳述、保證或承諾,造成另一方經(jīng)濟損失的,違反方應(yīng)依照合同約定承擔(dān)相應(yīng)的違約責(zé)任和賠償責(zé)任。 Any Party ho breaches the provisions of this Agreement, or its representations, arranties or convents made hereunder, causing the other Party loss, shall bear responsibility for compensation according to the Agreement term. 第9條 不可抗力 Force Majeure 房屋由于火災(zāi)、惡劣天氣、戰(zhàn)爭或其它不可抗力因素, 而不是因為乙方直接或間接的疏忽及故意行為造成房屋毀壞而不能被正常使用及居住時,乙方從該日起停止支付租金,直至房屋可再被使用及居住時為止。若甲方根據(jù)自己的意愿及經(jīng)濟、實際意義等原因認為沒有必要修繕復(fù)原房屋時,應(yīng)書面通知乙方,并在做出上述通知后三日內(nèi)將押金及預(yù)付租金全部退還乙方。 If the leased property are substantially destroyed or damaged by fire, bad eather, ar, and other factors of Force Majeure, and not attributable directly or indirectly to the negligence or malice of Party B or are otherise rendered unfit for use or occupation, the rent shall cease to be payable from the date the leased property become unfit for use or occupation until the leased property shall again be rendered accessible and fit for use, hoever, that the Party A shall be under no obligation to repair the leased property, hen in Party As opinion, it is not reasonably or economically or practically to do so.
